Always take PHOTOS of a rental property before you move in. If you don’t have photos showing the condition of the property before you moved-in, you still should be able to obtain them from the landlord/agent (on request), or by searching the property address online. WHY IS THIS IMPORTANT:
Many landlords and agents want their properties back in the SAME condition the property was in at the start of the tenancy. State tenancy laws and the real estate industry make allowances for FWT (FAIR WEAR AND TEAR).
Tenancy laws state that If a property has been rented-out, it is NOT FAIR or reasonable to expect the property to be returned in the same condition, prior to the rental period (hence, FAIR WEAR AND TEAR). The longer the rental period, the greater the allowance should be for ‘FAIR WEAR AND TEAR’,
Sadly, it is relatively common that the FWT tenancy agreement clause leads to conflicts and bond disputes for outgoing tenants with their landlords or agents, i.e., is a carpet WORN or DIRTY! We have been successful (Rental Bonds returned IN FULL), defending our clients (and sometimes our work), with the use of marketing photos found online and used as evidence to dispute property reports in defense of our clients.
However, it’s important to fully understand what the FWT clause means. The rental contract, FAIR WEAR AND TEAR clause, will generally protect tenants from having to pay or be responsible for any damage that occurs during NORMAL and ACCEPTABLE USE, i.e., if a carpet becomes worn (damaged), by walking on it, this would be classed as normal and acceptable wear and tear (the tenants are not responsible).
In simply terms, any damage that tenants may have caused by every day, normal, acceptable use is covered under the FWT tenancy clause. Deterioration of fixtures and fittings over time and through normal use is also covered under the FWT clause. FWT does NOT protect tenants for any intentional damage to the property as a whole; or damage caused through negligent and irresponsible use.
SUMMARY:
While the FWT tenancy agreement clause limits the tenant’s liability for any property damage caused through normal use and deterioration over time, i.e., fading/discolouring paint and worn carpets. It will NOT cover DIRT, GRIME, GREASE or DAMAGE, deemed to be intentional or damage caused through negligent and irresponsible use.
